Culture change
To achieve fundamental change in the justice system, we must examine our beliefs and attitudes about truth and justice. We need to look at key assumptions about the adversarial system and the roles of litigants, lawyers and judges. Do these still make sense in today's world?
Many common law jurisdictions have already implemented justice reforms aimed at making the system less adversarial. This adversarial culture is changing with the rise in collaborative processes, such as mediation and collaborative law.
