Application to
Obtain an Order
Use this form to apply for a court order to obtain spousal maintenance, child maintenance, custody, access or guardianship, or a restraining order.
   
Application to Change/Cancel
an Order
Use this form to apply to the court to change or cancel an order for spousal maintenance, child maintenance, custody, access or guardianship, or restraining order.
   
Financial
Statement
Use this form to record financial information if you are applying for a maintenance order for yourself or your child(ren), or to change or cancel a maintenance order. Please see instructions on the front of the form to determine if you must complete it.
   
Notice of Motion

Use this form to request a judge to make an order on an issue that must be addressed in addition to the main issue. For example, use the Notice of Motion to request permission to file your application in another court registry.

Please Note: Use 'Notice of Motion in Maintenance Enforcement Proceedings' to ask for an order relating to enforcement of a maintenance order, and 'Transfer Consent' if both parties consent to transfer a file to another registry, instead of this Notice of Motion.

   
Consent (to an
Order or to Vary
an Order)

Use this form when you and the other party agree on the terms of a court order. You must also complete either the 'Application to Obtain an Order' or the 'Application to Change/Cancel an Order'.

In addition, complete 'Request' to ask for a 'desk consent order' so a court appearance is not required.

   
Change of Address Notice Use this form to advise the court and other party of a change in your address. The Court Rules require you to file this form every time you change your address.
   
Subpoena Use this form to require a witness to attend court and give evidence. This form is generally only used if you do not expect the witness to attend court willingly.
   
Affidavit Use this form to provide additional information to support an application or notice of motion. Its use is generally optional.
   
Application to Enforce
a Custody Order
Use this form to ask to have a custody order enforced when the other party has failed to comply with the terms of the custody order.
   
Notice of Motion in Maintenance Enforcement Proceedings Use this form to ask a judge to make an order to deal with any 'side' issue relating to enforcement of a maintenance order.
   
Request for Court Enforcement under
the FMEA
Use this form to ask to have a maintenance order enforced, when the other party has failed to comply with the terms of the maintenance order.
   
Transfer Consent

Use this form to ask for a file to be transferred to another court location when both parties agree to the transfer.

Use the form 'Notice of Motion' instead if the parties do not agree to the transfer.

   
Statement of Finances
(FMEA)
Used by the maintenance payor to provide financial information to the Family Maintenance Enforcement Program (FMEP), if a maintenance order is enrolled with the FMEP.
   
Request to Adjourn Generally or
Withdraw Application

Use this form to request a court date be adjourned without a new date being scheduled.

Also use it to withdraw your application and cancel court proceedings permanently.

   
Reply Use this form to respond to an application and/or to submit a counterclaim.
   
Request

Use this form to request a 'desk consent order', so that a court appearance is not required.

The form 'Consent (to an Order or Vary an Order)' and either 'Application to Obtain an Order' or 'Application to Change/Cancel an Order' must also be used.

   
Fax Cover Page

Use this form to accompany any documents served by fax.
