Family Justice

The Best Option for You

If You Go to Provincial Court

What should I do if my former spouse does not obey the court order?

A court order is a legally binding document.

If a court order is not obeyed, it can be enforced by the courts and/or the police in various ways, depending on what type of order it is and other factors.

If your order includes spousal and/or child support, it can be enforced by the Family Maintenance Enforcement Program. Please see our section on the FMEP for more information.

If your order deals with custody, guardianship and access, please talk to a lawyer or staff at the Provincial Court nearest you for more information on enforcement and what you need to do to have your order enforced.
