When should I see a Family Justice Counsellor?

You should see a family justice counsellor if you:

  • need help in coming to an agreement with your former spouse about custody, guardianship or access, spousal or child support
  • want to obtain or change a custody, guardianship, access or support order in Provincial Court
  • would like to learn about the child support guidelines, the court process, or services that are available to help you and your family adjust to separation and divorce, and
  • want to understand more about separation and divorce in this province.

Family justice counsellors are accredited mediators. That means they are qualified to help you and your former spouse try to resolve your disagreements without going to court. For more about mediators, please see our section on Cooperative Approaches: Mediation and Collaborative Law.

Family justice counsellors are also trained to provide:

  • emotional support and short-term counselling
  • referrals to emergency and community services
  • information for people without lawyers about how to obtain or change child custody, guardianship, access and support orders or agreements in Provincial Court
  • information about Parenting After Separation sessions, and
  • custody and access assessments when ordered by the court.
Family justice counsellors do not provide legal advice, but they will refer you to legal services.
